The Claiborne Parish Police Jury met in regular session in the office of the Police Jury, located at 507 West Main Street in Homer, LA at 9:00 a.m. on the fifth day of August 2009. On being called to order by the President Scott Davidson, the following jurors were present:
Roy Mardis, Lavelle Penix, Danny “Roy” Lewis, Brian “Butch” Bays, Rev. Willie Young, Sr., Robert “Bob” McDaniel, Mark Furlow, Jerry Adkins, and Joe Sturges.
There were 16 others in attendance which included, Secretary-Treasurer Dwayne R. Woodard, Road Superintendent Tommy Durrett, Michelle Bates of the Guardian Journal, Jackie Roberts of The Haynesville News, OOCS Executive Director Jean Reynolds, Cathy Greeson with Claiborne Parish O.E.P., Dr. Alice Stewart with the Claiborne Parish Watershed District, J.T. Taylor of the Claiborne Chamber of Commerce, Njeri Camara with Alliance for Education, Teresa Price of Claiborne Parish 4-H, Theresa McDaniel with the Butterfly festival, James Spillers of Claiborne Parish Sheriff’s Department, Wendy Goad with the Region 7 Office of Mental Health, Trudie Abner with the Region 7 Office of Addictive Disorders, Jere Perry with the Region 7 Office of Public Health,and Alvin Womack with the United States Forestry Service,
The meeting was opened with a word of Prayer led by Rev. Willie Young, Sr. and followed by the Pledge of Allegiance led by Roy Lewis.
Upon motion by Mark Furlow, duly seconded by Lavelle Penix, the Jury unanimously voted to adopt the Agenda as presented.
Upon motion by Roy Lewis, duly seconded by Joe Sturges, the Jury unanimously voted to amend the Agenda and add the following:
1. Alvin Womack of the United States Forestry Services, presentation of a plaque of appreciation to the Claiborne Parish Police Jury and its staff.
2. A Request from the Coordinating & Development Corporation, in a letter
dated August 1, 2009, for a Resolution of support for expedited funding for the Camp Minden Regional Training Institute.
Upon request, item #9 was removed from the consent agenda and placed as the first item under the regular agenda. This item dealt with a request from the Town of Haynesville concerning help in demolishing a house located at 1861 Betters Way. This property has been adjudicated to the Police Jury.
Upon motion by Roy Mardis, duly seconded by Jerry Adkins, the Jury unanimously approved the following consent agenda. The following items were approved en masse.
1. Approval of the July 8, 2009 regular meeting minutes.
2. Payment of the July 2009 bills as approved by the Claims Committee.
3. Request from the First Baptist Church of Homer, in a letter dated July 21, 2009, requesting the use of the Court House lawn for a prayer walk on Sunday, August 16, 2009 at 6:45 P.M. The prayer walk will last approximately 15 minutes and is for the sole purpose of praying for the students and faculty of all schools, private and public within Claiborne Parish.
4. Request from the First Baptist Church of Homer, in a letter dated July 21, 2009, requesting the used of the Court House Lawn for a community outreach event on Sunday, September 6, 2009 from 11:00 A.M. to 4:00 P.M. Activities include moonwalks and small carnival activities for the kids along with free hamburgers, hotdogs, and other refreshments. The event is for the sole purpose of reaching out to those within our community with the love of Christ.
5. Acceptance and awarding of the lowest qualified sealed bids for the purchase of road material (iron ore) for the period of one year, beginning August 6, 2009 and ending August 5, 2010.
6. Resolution 2009-020 – A Resolution Calling for a Hearing for Public Input Concerning the Police Jury’s 2010 Housing Assistance Programs Five Year Administrative Plan and Annual Plan.

RESOLUTION 2009-020
A RESOLUTION CALLING FOR A HEARING FOR PUBLIC INPUT CONCERNING THE POLICE JURY’S 2010 HOUSING ASSISTANCE PORGRAMS FIVE YEAR ADMINISTRATIVE PLAN AND ANNUAL PLAN
WHEREAS, HUD, according to the Quality Housing and Work Responsibility Act of 1998 (QHWRA), all Public Housing Agencies (including the Claiborne Parish Police Jury) shall develop a Five Year Plan and an Annual Plan with a Statement of Mission, Goals and Objectives. The PHA (Claiborne Parish police Jury) shall prepare a plan and call a hearing to request comments and input from the community about said plan and then submit the completed plan to HUD;
BE IT HEREBY RESOLVED that the Claiborne Parish Police Jury shall call a hearing in the official newspaper. The hearing shall be to ask for comments from the public about input into the annual plan and the administrative plan to discuss the Mission, Goals and Objectives of the Section 8 Housing Assistance programs administered by the Police Jury. And, in addition, the hearing shall attempt to address the housing needs of the lower income population of the Parish. Copies of the proposed annual plan shall be displayed at the hearing to be held at the Claiborne Parish Police Jury Complex located at 507 West Main Street, Homer LA on Friday September 25, 2009 at 10:00 a.m. The hearing shall be open to the public.
Upon a motion by Roy Mardis and duly seconded by Jerry Adkins this motion was carried and officially adopted by the Claiborne Parish Police Jury meeting in regular session convened on Wednesday, August 5, 2009.

Regular Agenda:
Mr. Alvin Womack presented the Police Jury with a plaque for their support of the United States Forestry Services and for their public service assisting other agencies. He stated every time he needs something done, the Police Jury is always helpful in getting things accomplished. Mr. Womack announced the hiring of his new boss whose name is Mike Balboni and plans to bring him introduce him to the Jury soon.
Upon Motion by Jerry Adkins, duly seconded by Roy Mardis, the Jury unanimously approved the request from the Coordinating & Development Corporation, in a letter dated August 1, 2009, for a resolution of support for expedited funding for the Camp Minden Regional Training Institute. Secretary Treasurer, Dwayne Woodard stated a couple of years ago, the Police Jury made a Resolution to help land the funds Camp Minden Regional Training Center which they landed, with the help of other agencies. He also stated this is a letter to help expedite the funding to kick start that project a few years ahead of schedule.

WHEREAS, the Louisiana Army Ammunition Plant, formerly known as the Louisiana Ordnance Plant, produced munitions to support the war efforts of the United States of America during World War II, the Korean War and the Vietnam War and, in so doing, provided employment for thousands of workers in northwest Louisiana, south Arkansas and east Texas, and
WHEREAS, from 1941 until 1996, the Louisiana Army Ammunition Plant served as a major stimulus to the economy of northwest Louisiana, south Arkansas and east Texas, and
WHEREAS, the Louisiana Army Ammunition Plant was placed in an inactive status in 1996 and, in 2005, transferred from the United States Government to the State of Louisiana, and
WHEREAS, following the transfer of the Louisiana Army Ammunition Plant became known as the Camp Minden Training Site and the Governor, State of Louisiana charged the Louisiana National Guard with operational control of the installation, and
WHEREAS, since the transfer, the Louisiana National Guard has attracted and/or retained 20 businesses and organizations, which, when combined with Louisiana National Guard personnel, account for a total of 650 employees; and
WHEREAS, the Camp Minden military component accounts for a regional direct economic impact of more than $27 million annually in payroll and vendor sales; and
WHEREAS, the activities of the Louisiana National Guard have been responsible for generating an additional investment of $14 million for sustainment, restoration, and modernization during the period of FY05 through FY09; and
WHEREAS, during the next three to eight years, construction and continued planning is underway for a Regional Training Institute, Armed Forces Readiness Center, Dining Facilities, Barracks, Military Training Ranges, Unit Training Facilities, and Training Site Support Structures on Camp Minden with a projected cost $145 million, and
WHEREAS, the Regional Training Institute will provide training for more than 8,000 military students annually, and
WHEREAS, in Fiscal Year 2009, the Federal Government appropriated $23.8 million to fund Phase 1 construction of the Regional Training Institute.
WHEREAS, the estimated annual budget for the Regional Training Institute includes $12 million for purchase of goods and services, $5 million operating cost and $8 million payroll, thus infusing a total of $25 million stimulus into the regional economy, and
WHEREAS, during the 2007 Regular Session of the Louisiana Legislature, $2.6 million was appropriated for Camp Minden infrastructure rehabilitation, planning, design and construction, and
WHEREAS, during the 2007 Regular Session of the Louisiana Legislature, $449,000 was appropriated for fire trucks and fire equipment for the Camp Minden Fire Department, and,
WHEREAS, in 2008 Governor Bobby Jindal approved the use of $4 million from the State Mega Fund to construct a Consolidated Dining Facility on Camp Minden, and
THEREFORE, BE IT RESOLVED that the Claiborne Parish Police Jury does hereby commend the Louisiana National Guard for contributing to the economic well-being of this region and its citizens, and does hereby recognize and record for posterity that the Louisiana National Guard is the most significant economic development activity located at Camp Minden.
BE IT FUTHER RESOLVED that the Claiborne Parish Police Jury pledges support to the Louisiana National Guard economic efforts on Camp Minden and encourages the Louisiana National Guard, The Honorable Governor Bobby Jindal, The Honorable Senator Mary Landrieu, The Honorable Senator David Vitter and The Honorable Congressman John Fleming to obtain all required funding to complete the construction of the Regional Training Institute and Armed Forces Readiness Center on Camp Minden in a timely manner.
AND, BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to The Adjutant General, State of Louisiana; The Honorable Governor Bobby Jindal, The Honorable Senator Mary Landrieu, The Honorable Senator David Vitter, The Honorable Congressman John Fleming, The Honorable Congressman Steve Scalise, The Honorable Congressman Joseph Cao, The Honorable Congressman Charlie Melancon, The Honorable Congressman Rodney Alexander, The Honorable Congressman William Cassidy, and the Honorable Congressman Charles Boustany Jr.

In a letter dated July 28, 2009, the Town of Haynesville requested the Police Jury’s assistance in demolishing a house located at 1861 Better Way which has been adjudicated to the Police Jury. Robert McDaniel, Chairman of the Building and Grounds Committee stated he had been out to look at this property and there is a house which is also vacant approximately 10 ft. from the house needing to be demolished. Mark Furlow stated his concern in burning it and also demolishing the house. After much discussion and upon motion by Mark Furlow, duly seconded by Jerry Adkins, the Jury unanimously approved the request from the Town of Haynesville, upon condition that Road Superintendent Tommy Durrett, along with members of the Buildings and Grounds Committee, would decided the most cost effective and safest way to remove the house.
Upon motion by Lavelle Penix, duly seconded by Roy Mardis, the Jury unanimously voted to not honor the request (that was tabled from the July 8, 2009 meeting) from the Gilgal Water System, in a letter dated June 17, 2009, in regards to financial help for the cost of the relocation of a system water line on Old Arcadia Rd. where the Claiborne Parish Police Jury and the Webster Parish Police Jury are having a bridge replaced through the State of Louisiana’s Off-System Bridge Program. Secretary-Treasurer Woodard stated he discussed the issue with the Parish Attorney as requested in the July 8, 2009 meeting and the conclusion was the same as the Webster Parish Police Jury’s Attorney. The reason was that due to the fact of how our ordinances are written, any line in our right of way needing to be moved due to an infrastructure improvement (road or bridge), the utility company is to bear the expense of having that line moved. Our attorney also state that if you did this for one utility company, you would be setting a precedent and in the future you would have to do it for all utility companies which could potentially run into a lot of expense.
The naming of a replacement for Mr. Gene Coleman as the Parish’s Representative on the Sparta Water Commission was tabled from the July 8, 2009 meeting. The decision was made at the July meeting to advertise in the local paper for interested applicants. There were three applicants: Benny Lowery, James Banks, and Buddy Toadvin. The President opened the floor for nominations. Roy Mardis nominated Mr. Benny Lowery which was duly seconded by Rev. Willie Young. The President asked if there were any more nominations, Rev. Willie Young made a motion that the floor be closed to further nominations which was seconded by Roy Mardis, the floor was closed to nominations. There being no other nominations, the Jury unanimously approved Mr. Bennie Lowery for replacement of Gene Coleman on the Sparta Water Commission whose term expires in October of this year.
Upon motion by Roy Mardis, duly seconded by Rev. Willie Young, Sr., the Jury unanimously approved Resolution 2009-021 - A resolution to Adjust Payment Standard to 100% Fair Market Rent. Secretary-Treasurer Woodard stated that currently the Section 8 landlords don’t receive the entire FMW rent for their houses. This resolution would give the Section 8 Housing Landlords the full amount of rent for their houses and will allow better housing for the tenants under Section 8 Housing. He stated the money would come from HUD.

RESOLUTION 2009-021
A RESOLUTION TO ADJUST PAYMENT STANDARD TO 100% OF FMR
WHEREAS the Department of Housing and Urban Development has published its annual FMR’s and in keeping with the rental market in our area, it has become evident that we need to adjust our Payment Standard to 100% of our FMR for all bedroom size units; and
WHEREAS the Claiborne Parish Police Jury recognizes the economical changes and the limit of our rental stock and in keeping with these changes we hereby change our Payment Standard to 100% of FMR for all unit sizes. This will allow eligible families to find and rent affordable units in our jurisdiction.
BE IT HEREBY RESOLVED that the Claiborne Parish Police Jury AUTHORIZES the adjustment of our Payment Standard to 100% of our FMR for all bedroom size units effective September 1, 2009.
Upon a motion by Roy Mardis and duly seconded by Rev. Willie Young this motion was carried and officially adopted by the Claiborne Parish Police Jury meeting in regularly scheduled meeting convened on Wednesday, August 5, 2009.

Upon motion by Jerry Adkins, duly seconded by Roy Mardis, the Jury unanimously approved to enter into an engagement agreement with Hulsey, Harwood & Co., APAC, to perform the annual audit for the year ended December 31, 2009, as per letter dated July 27, 2009.
Upon motion by Jerry Adkins, duly seconded by Roy Lewis, the Jury unanimously approved the request from Claiborne Parish Highway Superintendent, Tommy Durrett, to attend the LPESA 2009 Fall Conference on September 10-11 in Baton Rouge, Louisiana.
Upon motion by Rev. Willie Young, Sr., duly seconded by Roy Mardis, the Jury unanimously approved the request from the Claiborne Parish Watershed District for the Police Jury’s assistance in assessing the silting and vegetation problem on Blackmon’s Treasure Island. After much discussion, the Jury determined there was a need for an assessment from Tommy Durrett, Claiborne Parish Highway Superintendent and the Claiborne Parish Watershed District to see what could be done to remove the silt and vegetation.
Upon motion by Joe Sturges, duly seconded by Mark Furlow, the Jury unanimously approved the DRAFT of a resolution for closing 400 yards of Old Hwy 9 at the request of Patriot Rail Road (LN & W) for possible location of a new business locating to this area. President Davidson stated this was not to approve the road closure at this time, but only to form a resolution for closing the road if the business relocates. Secretary-Treasurer Woodard said he would advertise it this month in the newspaper and hold a public meeting for Patriot Railroad to answer questions from the public the morning of the September 16, 2009 regularly scheduled Police Jury meeting. He also stated he had discussed this with the Parish Attorney and the resolution would clearly state if Patriot does not succeed in luring this new business here, the road would remain open.

A DRAFT OF THE RESOLUTION TO CLOSE A 400 YARD PORTION OF PARISH ROAD NO. 179, THE DANSBY ROAD, SITUATED IN SEC. 25 OF T20N, R7W OF CLAIBORNE PARISH
WHEREAS, the Parish of Claiborne has received the Louisiana and North West Railroad Company, Inc. (Patriot Rail) in a letter dated June 1, 2009, requesting the closure and abandonment of Old LA Highway 9 (Parish Road No. 179, Dansby Road) for 400 yards northward from its intersection with current LA Highway 9 and the removal of said portion of Parish Road No. 179, the Dansby Road, from the Claiborne Parish Road System; and
WHEREAS, the purpose of the closure is to allow enough room to build additional side track and to provide necessary clearance for truck access in an attempt to lure new businesses to locate in Claiborne Parish; and
WHEREAS, the proposed closure of this road section is not presently used for school bus pickup, trash pickup, and mail delivery; and
WHEREAS, the Claiborne Parish Police Jury will not continue to maintain the said portion of Parish Road No. 179 if it is closed; and
WHEREAS, the Claiborne Parish Police Jury, duly advertised and held a public hearing concerning proposed abandonment of said portion of Parish Road No. 179, the Dansby Road; and
NOW, THERE FOR BE IT RESOLVED, by the Claiborne Parish Police Jury in due, legal and regular session convened, that the Parish of Claiborne does hereby abandon the afore mentioned portion of Parish Road No. 179, the Dansby Road, and will not maintain the said road in the future.
BE IT FURTHER RESOLVED that this resolution shall only go into effect if the Louisiana and North West Railroad Company, Inc. (Patriot Rail) is successful in luring a new business to said location.

Robert McDaniel thanked Scott Davidson, Joe Sturges, Jerry Adkins, Lavelle Penix, and Secretary-Treasurer Woodard for attending the Building and Grounds Committee meeting last Thursday.
Upon motion by Robert McDaniel, duly seconded by Lavelle Penix, the Jury unanimously approved the recommendation from the Building and Grounds Committee, to remove the concrete ramps at the Courthouse from the agenda due to contractors bidding not having adequate insurance and excessive bid prices. Robert McDaniel stated that upon advice from Parish Attorney Danny Newell, who recommends that anyone doing work for the Police Jury needs to have the proper insurance, that all such vendors submit proof of insurance.
Upon motion by Robert McDaniel, duly seconded by Joe Sturges, the Jury unanimously approved the recommendation from the Building and Grounds Committee to withdraw the previous bid on repairing the windows at the Armory from Daniel Speer Roofing Inc. of Minden because he could not provide proof of insurance and that the work be awarded to McKinnie Metal Roofing of Jonesboro in the amount of $8,200 which will include all lower windows.
Upon motion by Robert McDaniel, duly seconded by Joe Sturges, the Jury unanimously approved the recommendation from the Building and Grounds Committee to purchase the old Claiborne Electric Co-Op Building for $150,000. Rev. Willie Young, Sr. voiced his concern for the environmental safety since the old transformers used to contain PCB’s. Secretary-Treasurer Woodard stated the Claiborne Electric has had the property inspected and it is cleared of all hazardous materials and they are in the process of providing us a copy. President Scott Davidson stated the fuel tanks are being used as we speak by the Claiborne Sheriff’s Department. Mark Furlow stated the fuel pumps contain key pads so each individual vehicle can be tracked of how much fuel is being used for that vehicle.
Upon motion by Robert McDaniel, duly seconded by Roy Lewis, the Jury approved with a vote of 8 to 2 the recommendation from the Building and Grounds Committee, to form a committee consisting of Parish Attorney Danny Newell, Secretary-Treasurer Woodard and Buildings & Grounds Committee Chair Robert McDaniel to negotiate the possible purchase of the old USDA Building on behalf of the Police Jury to accommodate office space needs for other agencies within the Parish. Rev. Willie Young, Sr. and Roy Mardis voted against the negotiation in possible purchase of the old USDA building due to the poor economy.
Upon motion by Robert McDaniel, duly seconded by Lavelle Penix, the Jury approved with a vote of 8-2 the recommendation from the Building and Grounds Committee for the same committee to explore the possibility of purchasing the 10-12 acres location of the old auction barn just north of town for use by the Police Jury for possible future growth. Rev. Willie Young, Sr. and Roy Mardis voted against the negotiation due to hard economic times.
Secretary-Treasurer Woodard gave an update on the status of the roof at the Claiborne Parish Library. He stated that Parish Engineer Brad Graff is working on drawing up specifications for the bids. According to the insurance company, we have to bid this project two ways since the insurance will only pay for the repair of the roof - 1) repairs to existing roof to restore it to the state before the storm damage and 2) total replacement of the roof and necessary repairs. Secretary-Treasurer Woodard also gave an update on the progress of the Large Jury Meeting Room. He stated he is waiting on Delta Interiors to install the curtain and lay the carpet and it should be ready for next month’s meeting.
Upon motion by Mark Furlow, duly seconded by Jerry Adkins, the Jury unanimously approved awarding the Parish’s Hazardous Mitigation Program bid to Metro Planning, Inc. in the amount of $65,000. Secretary-Treasurer Woodard stated we had three bids with the same amount. The companies were S. E. Huey, Dewberry, and Meto Planning, Inc. He said he discussed these companies with Scott Greeson of E-911 and Sheriff Ken Bailey who also recommended Metro Planning, Inc. mainly because they have committed to giving the Jury a final draft of the updated Hazardous Mitigation Plan no later than 10 months after signing the contract. He also stated this would be paid from grant money allocated for this program.
Upon motion by Roy Mardis, duly seconded by Joe Sturges, the Jury unanimously approved the request from Secretary-Treasurer Woodard, to purchase a new server for the administrative office at a cost of approximately $4,300. He stated the current server is about 5 years old and he is trying to keep the Police Jury’s equipment updated and in good working condition. He said currently we are backing up our system online, but this new system will allow us to use a tape back up system.
Ms. Njeri Camara, Associate Director of the North Louisiana Human Service District Investigative/Research Committee, gave a brief summary and presentation of their final report for Region 7.
President Scott Davidson announced the installation of the historic marker at Alabama Cemetery is complete and in place. This marker was donated be Claiborne, Bienville, and Lincoln Parishes and marks the location in which all three parishes meet.

Public Comment:
Secretary-Treasurer Woodard read the invitation from Congressman John Flemming’s Office to all elected officials for a meeting Augest 27th, at 2:45 P.M. here at the Police Jury.
Teresa Price of the Claiborne Parish 4-H thanked the supporters of Claiborne Parish 4-H and gave a brief summary of the upcoming events. She also announced Rick Rowe of Channel 3 will be at the Lake Claiborne State Park Friday morning.
Theresa McDaniel of the Claiborne Parish Butterfly Festival announced the annual Butterfly Festival will be held Saturday, September 12th. T-shirts are on sale at area businesses. She also stated John Wesley Cooper would truly be missed as he did such a great job with the Butterfly Festival. President Scott Davidson stated that Mr. John Wesley Cooper was a fine man and that we would all miss him.
Dr. Alice Stewart of the Claiborne Parish Watershed District gave a brief update of meetings she has attended and is excited about the different programs being started on water conservation here in North Louisiana.
Deputy James Spillers of the Claiborne Parish Sheriff’s Department stated to the Jurors how proud he and Sheriff Ken Bailey is of the purchase of the Old Claiborne Electric Building. He said this will not only help Claiborne Parish, but other surrounding Parishes use this building for interrogations and other criminal investigations going on within Claiborne Parish.
