MINUTES OF POLICE JURY MEETING

HELD FEBRUARY 6, 2003

HOMER, LOUISIANA

 

The Claiborne Parish Police Jury met in regular session at the office of the Police Jury in Homer, La. at 10:00 am on February 6, 2003. On being called to order by the President, the following members were present:

 

Gene Coleman, Bobby Liles, Roy Mardis, Brian Bays, Rev. Willie Young, Sr., Roy Lewis, Jack Price, Jerry Adkins, Joe Sturges, and Weldon Kilpatrick.

 

            All members were present.

 

At this time, the President, Weldon Kilpatrick, presented to the family of Neal Hardy, the resolution adopted by the Police Jury in their January meeting.

 

Upon motion by Rev. Willie Young, seconded by Roy Mardis and carried, a correction was made to the minutes of January 9, 2003. The correction was that the vote was 6 to 3 in favor of Roy Lewis for vice-president.

 

Upon motion by Bobby Liles, duly seconded and carried, the minutes of January 9, 2003, were approved and adopted with one correction as stated above.

 

ORDINANCE NO. 733

 

AN ORDINANCE STATING THE SPEED LIMIT AND PROVIDING FOR THE FINE FOR ANY PERSON WHO VIOLATES THE SAME ON THE TOTAL LENGTH OF PARISH ROAD NO. 28, THE MAIN ROAD.

 

SECTION I.  BE IT ORDAINED by the Police Jury of Claiborne Parish, Louisiana, in regular session convened that the Speed Limit is hereby set at twenty-five miles per hour on the total length of Parish Road No. 28, the Main Road.

 

SECTION II.  BE IT FURTHER ORDAINED by the Police Jury of Claiborne Parish that any person convicted of being in violation of the Speed Limit on this road shall be guilty of a misdemeanor and be fined no more than One Hundred Dollars ($100.00) or serve not more than thirty (30) days in the Parish Jail, or both.

 

SECTION III.  BE IT FURTHER ORDAINED by the Police Jury of Claiborne Parish that all Ordinances or Resolutions, or parts thereof, in conflict herewith, be and they are hereby repealed.

 

Upon motion by Brian Bays duly seconded by Jack Price the Ordinance was adopted by the following YEA and NAY vote:

 

YEAS: Gene Coleman, Bobby Liles, Roy Mardis, Brian Bays,

            Rev. Willie Young, Sr., Roy Lewis, Jack Price, Jerry Adkins,

Joe Sturges and Weldon Kilpatrick.

 

NAYS:  None

 

ABSTAIN:  None

 

ABSENT: None

 

WHEREUPON, the Ordinance was declared duly passed on this the 6th day of February, 2003.

 

 

 

 

 

RESOLUTION

 

WHEREAS, the Congress of the United States has enacted both the Government Pension Offset (GPO), reducing the spousal and survivor social security benefit, and the Windfall Elimination Provision (WRP), reducing the earned social benefit for persons who also receive a state or local government retirement, and

 

WHEREAS, the intent of congress in enacting the GPO and WEP provisions was to address concerns that public employees who had worked primarily in state and local government employment receive the same benefit as workers who had worked in covered employment throughout their careers, thereby providing a disincentive to “double dipping”; and

 

WHEREAS, the GPO affects a spouse or survivor receiving a state or local government retirement benefit, who would also be entitled to a social security benefit earned by a spouse; and

 

WHEREAS, the GPO formula reduces the spousal or survivor security benefit by two-thirds of the amount of the state or local government retirement benefit received by the spouse or survivor, in many cases completely eliminating the social security benefit; and\

 

WHEREAS, the WEP applies to those persons who have earned a state or local government retirement benefit in addition to working in covered employment and paying into the social security system, and

 

WHEREAS, the WEP reduces the earned social security benefit using an averaged indexed monthly earnings formula and may reduce social security benefits for such persons for as much as one-half of the uncovered public retirement benefits earned;  and

 

WHEREAS, because of these calculation characteristics, the GPO and WEP have a disproportionately negative effect on employees working in lower wage government jobs, like policemen, firefighters, and teachers;  and

 

WHEREAS, these provisions also affect more women than men because of the gender differences in salary that continue to plague our nation; and

 

WHEREAS, Louisiana is making every effort to improve the quality of life of her citizens and to encourage them to remain here life long;

 

THEREFORE BE IT RESOLVED that the Claiborne Parish Police Jury does hereby memorialize the Congress of the United States to review the GPO and WEP social security benefit reductions and to consider eliminating them.

 

BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the Claiborne Parish Legislative Delegation, to the Police Jury Association of Louisiana and to all police juries or parish councils in Louisiana.

 

Upon motion by Bobby Liles duly seconded by Jerry Adkins and carried the foregoing resolution was duly adopted by the Claiborne Parish Police Jury in regular session convened on February 6, 2003.

 

RESOLUTION

 

WHEREAS, agriculture is the leading industry and largest employer in many parishes in the State of Louisiana and is a capital intensive industry and vulnerable to weather extremes; and

 

WHEREAS, farmers in the State of Louisiana have suffered severe economic disaster during 2002 due to such extremes including drought, hurricanes and torrential rainfalls, which situation was compounded by historically low commodity prices and no federal crop disaster relief;; and

 

WHEREAS, many farmers and businesses including sugar cane farmers and related businesses will be unable to survive these trying economical times; and

 

WHEREAS, it has been reported that the United States Presidential Administration under the leadership of the Honorable George W. Bush, is working with the United States Trades Representative Office toward negotiations with the Mexican government for additional imports of Mexican sugar into the United States; and

 

WHEREAS, these negotiations may lead to United States policy and/or legislation which could be detrimental to the sugar producing areas of the country including the State of Louisiana which produce large volumes of sugar.

 

NOW, THEREFORE, BE IT RESOLVED that the Claiborne Parish Police Jury does hereby express its strong opposition to any proposed Federal negotiations and/or legislation which would enable, authorize and/or increase the importation of Mexican sugar into the United States which proposal would be detrimental to the sugar industry in the State of Louisiana.

 

BE IT FURTHER RESOLVED that the Claiborne Parish Police Jury is hereby further requesting that the Governor of Louisiana, the Claiborne Parish Congressional and Legislative Delegations, the Police Jury Association of Louisiana and all parish government of the State of Louisiana join in expressing their united opposition to any proposed Federal negotiations and/or legislation for this purpose.

 

Upon motion by Bobby Liles, duly seconded by Roy Lewis and carried, the foregoing resolution was adopted by the Claiborne Parish Police Jury in regular session convened on February 6, 2003.
